However, a slight exception is outlined in Article XII, Section 7 of the same constitution, which allows heirs, regardless of their nationality, to inherit property if the deceased Filipino spouse did not leave a will.<\/p>\n\n\n\n<p>It means a foreign individual can acquire real estate in the Philippines if they\u2019re a lawful or natural heir through hereditary inheritance AND NOT by being explicitly named in the \u201cLast Will and Testament\u201d of a property owner.<\/p>\n\n\n\n<p>Article 887 of the New Civil Code of the Philippines states that \u201clegitimate children and descendants, with regard to their legitimate parents and ascendants,\u201d are mandatory heirs.<\/p>\n\n\n\n<p>Succession of property in the Philippines follows a <strong><em>hierarchy<\/em><\/strong>:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Legitimate children or descendants of the deceased;<\/li>\n\n\n\n<li>Legitimate parents or ascendants;<\/li>\n\n\n\n<li>Illegitimate children or descendants;<\/li>\n\n\n\n<li>Surviving spouse;<\/li>\n\n\n\n<li>Siblings (brothers and sisters), nephews, and nieces;<\/li>\n\n\n\n<li>Other collateral relatives within the fifth degree; and finally,<\/li>\n\n\n\n<li>The State (Philippines).<\/li>\n<\/ol>\n\n\n\n<p>Under the hierarchy above, foreigners can possess and acquire real property, whether farmland or private land, inherited from their deceased Filipino spouse, subject to the shares of any surviving relatives.<\/p>\n\n\n\n<p>The overview above concerns a foreign expat<span style=\"text-decoration: underline;\"><em><strong> inheriting last<\/strong><\/em><\/span> from their Filipino spouse.&nbsp;<strong>This does not allow expats to inherit land from someone they were not married to.<\/strong><\/p>\n\n\n\n<p>The Philippine Supreme Court ruled in 1982 that&nbsp;<a href=\"https:\/\/lawphil.net\/judjuris\/juri1982\/feb1982\/gr_l_27952_1982.html\" target=\"_blank\" rel=\"noreferrer noopener\">foreigners inheriting land<\/a>&nbsp;from any Filipino who wasn\u2019t their spouse would be unconstitutional.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>\u201cAny alien would be able to circumvent the prohibition by paying money to a Philippine landowner in exchange for a devise of a piece of land.\u201d <\/em><\/p>\n<cite><em>Ramirez vs. Vda. de Ramirez, G.R. No. L-27952<\/em><\/cite><\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"ownership-by-a-foreigner-who-was-a-natural-born-filipino\">Ownership by a Foreigner who was a Natural-Born Filipino<\/h2>\n\n\n\n<p>According to the Philippine Constitution, a natural-born Filipino citizen refers to an individual who is a citizen of the Philippines from birth without the need to take any actions to acquire or perfect their Philippine citizenship. This definition encompasses the following criteria:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Filipino citizens who have possessed dual citizenship<\/li>\n\n\n\n<li>Filipino citizens who have possessed derivative citizenship<\/li>\n\n\n\n<li>Married a foreign national but retained their Filipino citizenship (they have not yet acquired foreign citizenship)<\/li>\n\n\n\n<li>A naturalized citizen according to the Philippines\u2019 Naturalization Law<\/li>\n\n\n\n<li>A Filipino citizen during the time of the 1987 Constitution adoption<\/li>\n\n\n\n<li>Those who were born before the signing of the 1973 Philippine Constitution (January 17, 1973) and have decided to elect Filipino citizenship by the age of 18 years old (they may be born anywhere in the world, as long as to a Filipino citizen;
