The Revised Penal Code of the Philippines, which governs criminal offenses in the country, defines statutory rape as the sexual intercourse with a woman under 18 years of age, even if the minor gives her consent. The law considers minors below the age of 18 as incapable of giving informed consent due to their age and lack of maturity.

Statutory rape laws in the Philippines

In the Philippines, statutory rape is defined as sexual intercourse or sexual activity with a person under the age of 18, regardless of whether or not the minor gives consent. The Revised Penal Code of the Philippines, which governs criminal offenses in the country, defines statutory rape under Article 266-A. The law states that sexual intercourse or lascivious conduct with a minor under the age of 12 is automatically considered rape, while sexual intercourse or lascivious conduct with a minor between the ages of 12 and 17 is considered statutory rape.

The penalties for statutory rape in the Philippines can be severe. The law states that the offender shall be punished with the penalty of reclusion perpetua (imprisonment for 20 years and one day to 40 years) if the victim is under 12 years old. If the victim is between 12 and 17 years old, the penalty will be prison mayor (imprisonment for six years and one day to 12 years).
